IMPORTANT UPDATES
We confirm that the Special Managers, Official Receiver or anyone legitimately acting on their behalf will never ask for a fee to recover some or all the funds owed to you by any of the Thomas Cook Companies in liquidation. If you are approached by a third party and asked to pay a fee to help you recover your money from the Thomas Cook liquidations it is highly likely that a scam is being attempted. If you think that someone is attempting to scam or defraud you, you should do the following:
- report all fraudulent contact from individuals via Gov.uk
- report these approaches to Action Fraud
The Financial Conduct Authority (FCA) also publishes a list of known fraudulent claims management companies you can check online. However, if the company that has contacted you is not on the list it does not mean that they are not attempting to scam or defraud you.
Details of how to submit your claim for monies owed prior to liquidation on 23 September 2019 can be found in the “Supplier Frequently Asked Questions” document below under statutory notices and reports.
Important Information to Landlords – Expense Claims must be submitted by 14 September 2023
The Interpath Special Managers applied to Court for directions so that the Companies’ remaining assets can be distributed without needing to make provision for contingent claims by landlords in respect of potential liquidation expenses (being claims for the payment of a debt or liability as an expense of the winding up of the Companies in the manner provided for under English law, including pursuant to and within the meaning of Rule 7.108 of the Insolvency (England and Wales) Rules 2016 (an "Expense Claim")).
Following the hearing of an application on 11 July 2023, the Court made an order imposing a bar date of 14 September 2023 (the "Bar Date") for the submission of further Expense Claims in the liquidation of the Companies. After 14 September 2023, the expiry of the Bar Date, you will not be able to make such an Expense Claim in the liquidation and if you have not made a claim before the Bar Date, you will lose your right to receive any distribution from the Companies in respect of your potential Expense Claim.
If you consider that you are still owed these amounts (or any other amounts) during the period of the licence please ensure that you send any outstanding invoices for sites occupied under licence by Hays Travel Limited to us immediately at TClandlords@interpathadvisory.com and in any event before the Bar Date of 14 September 2023. If you do not, you will lose your right to make an Expense Claim.
When submitting invoices, please ensure that you include all necessary payment instructions and/or bank account information
Please see our Final Request letter to landlords dated 31 July 2023 for further information.
